Regulation of International Transactions: New Act on Foreign Investigation

Since April, the first draft of a paragraph wording of the new Foreign Investment Screening Act has been available, which is due to come into effect in half a year, i.e., in January 2020. It is a fundamental change for a number of investments coming from abroad to the Czech Republic. In addition, the Act does not only apply to investments coming from outside the EU, but also from EU investors if a non-EU company can "directly or indirectly exercise decisive influence over them.” It is clear that any major investment will now be subject to at least a check on whether the new Act will apply to it or not.
